From OcioHogar Home Design, S.L. (hereinafter, we), we make available to you these terms and conditions (hereinafter, the “General Conditions”) which regulate:

  • Accessing, using, browsing, or registering on the website located under the this domain (hereinafter, the “Web”).
  • Downloading and using any information, text, images or other content that you can access from the Web.

What is tidestay.com?

Our website contains a technological platform that we make available to our users so that they can publish advertisements for the rental of properties, or search for a property (hereinafter, the “Main Services”).

We simply facilitates contact between users offering a property and those looking for one. We do not participate in any transactions that may arise from these contacts. We are not a real estate agency, nor do we buy, sell, or rent properties.

Access to and acceptance of the General Conditions

By accessing or using the Website, you do so under your sole and exclusive responsibility, thereby becoming a user (hereinafter, “User” or “Users”) and acknowledging that you have read, understood, and expressly agree to comply without reservation with these General Terms and Conditions in the version published at any given time. If you use Services that require registration, whether for personal or professional purposes, you will become a registered user (hereinafter, “Registered User” or “Registered Users”), and this will also imply your acceptance of the specific terms and conditions that may replace, supplement, and/or modify these General Terms and Conditions (hereinafter, the “Specific Terms and Conditions”), as applicable in each case.

We reserve the right to expand, modify, replace, and/or cancel our Services and/or these Terms and Conditions at any time. In any case, we will make every effort to notify you of any significant changes to the Terms and Conditions well in advance. In particular, if you are a Registered User, we will notify you by email to the email address you provided during registration. Your use of the Website must comply with these General Conditions, and, where applicable, the Special Conditions, the policies and publishing guidelines, the law in force at any given time, morality, good customs and public order.

    • Contact the advertisers of the properties you are interested in.
    • Register your profile in the specific case that you are looking to rent a property.
    • Advertise for rent properties that are your property or under your management.
  • You cannot:
    • To introduce, share, disseminate or publish:
    • Content of a racist, xenophobic, obscene or denigrating nature (e.g., advertisements that allude to the origin or nationality of those interested in the property or that include insults or offensive words of any kind).
    • Content that incites criminal, terrorist, violent or defamatory acts based on age, gender, religious beliefs, language or any other factor (e.g., advertisements that allude to or express preferences regarding the sexual orientation, age range or religion of those interested in the property).
      Illegal content or content that infringes upon the fundamental rights of third parties in any way.
      Information that constitutes illegal or unfair advertising (e.g., advertisements with fictitious prices or that include misleading or offensive comments about competitors).
    • Content that violates the secrecy of communications and/or the applicable regulations on the protection of personal data (e.g., advertisements that reveal the identity of owners, occupants or any third parties who have not given their consent to make their data public).
    • False, inaccurate or fraudulent content that may mislead the recipients of such information (e.g., “hook” ads or ads containing misleading descriptions or false characteristics of the properties).
    • Do not use the Web for illicit purposes, nor for resale, transfer or disposal for the use or benefit of any other person or entity.
    • Do not cause damage to this platform or third parties, nor introduce or spread computer viruses or other types of harmful systems that may cause damage to computer systems.
    • Performing acts that infringe upon our intellectual property rights and/or cause reputational damage to us or third parties.
    • Using the identity and/or access codes or password of a third Registered User without their consent.
    • Accessing, controlling, or copying any information included on this Website using any type of robot, spider, scraper, or other automatic means or manual process for any purpose, without our express written permission.
    • Violating the restrictions of the robot exclusion notices included on this Website, as well as bypassing or circumventing other measures employed to prevent or limit access to this Website.
    • To undertake any action that imposes or may impose, in our judgment, an unreasonable or disproportionately large burden on our infrastructure.
    • Establishing a link to any content on this Website for any purpose whatsoever and without our express written permission.
    • Replicating, mirroring, or otherwise incorporating any content from this Website into any other website without our prior written authorization is prohibited.

What happens if you perform any of these actions, violate our terms and conditions, or publish illegal content in general?

If you engage in any of these behaviors, you will be liable for any damages that may arise and you agree to indemnify us.

Furthermore, in the event of any direct or indirect breach of these General Conditions, the applicable Special Conditions, or current legislation, we may remove, block, or restrict the visibility of your ads and/or content and, after prior notice, we reserve the right to delete your account, as well as suspend or limit access to and use of our Website and our Services, without this giving rise to any compensation on our part.

If you disagree with the decisions made by us regarding its content moderation and control policy on the Website, you can explain your reasons by contacting us directly at the same email address from which we will inform you of our decision. Please note that you have six months from the date we notify you to express your objection. You may also file a claim with any certified out-of-court dispute resolution body.

What happens if you detect that someone is doing it?

If you belong to a security force or act on behalf of an authority, you can request information from us or report any improper or illegal activity by sending us an email directly to autoridades@ociohogar.com
We take any report of illegal or inappropriate content very seriously. The moment we receive a notification, whether from other users or the relevant authorities, we immediately and thoroughly investigate the issue.

Submitting properties

To offer your property on our website by publishing an ad, you must register and provide all the required information to register as an advertiser. You must complete the information and provide the documentation we request; otherwise, you will not be able to access our services or publish ads. We may request additional information, especially if you are a professional client, to verify your identity and legitimacy to publish on our platform.

If your request for our services is denied due to insufficient or missing information, and you disagree with our decision, you may notify us within six months using the contact email address we provide.
Please note that it is mandatory to complete all required fields in a listing for it to be published. If you do not complete them, we reserve the right to assign tags or categorize the property based on the listing’s content, or to suspend publication until the property has all the required fields, in order to offer a better service and facilitate user searches.

Notwithstanding the foregoing, by posting an advertisement, you guarantee that all information is truthful, accurate, complete, and up-to-date. We will strive to verify the truthfulness and accuracy of the information published in advertisements, but we cannot fully guarantee its accuracy. It is your responsibility, as the advertiser, to keep the information up-to-date at all times, notifying us as soon as possible if any information is outdated or inaccurate. It is also your responsibility to comply with the regulations applicable to the advertisements you publish; this includes, but is not limited to, any legal provisions relating to the rental and/or sale of properties.

Furthermore, by posting an ad, you acknowledge that you are the sole owner of the property you are advertising (or that you are duly authorized by the owner or the other co-owners of the property to publish it) and that you are solely responsible for the accuracy of the published information. Therefore, you will assume exclusive liability for any damages that may arise in this regard.

If you are a Private Advertiser, you acknowledge that the use of the free ad posting service is limited to the publication of a maximum of 2 properties (for sale and for rent), which you can keep published for up to 9 months.

Once you’ve used up your free listings, if you want to list an additional property other than a room, you’ll need to purchase one of the paid subscription services.

Finally, please note that we may retain some data from the date the last listing was deactivated in order to prevent misuse of the free service or any type of fraud.

Ad Posting Guidelines

By using the ad posting services, you agree to:

Do not post repeated images or images with any type of frame, watermark, logo, or text, nor compositions of multiple images or videos created from photo montages of the properties. Photo carousels are also not permitted in listings.

Do not publish ads without images or with images, plans or any other type of multimedia content (such as videos, virtual tours or 3D images) that are not relevant to the ad (such as, for example, empty images, monuments, tourist or commercial areas of the property area, animals or people).

Do not publish listings with images, floor plans, or any other type of multimedia content (such as videos, virtual tours, or 3D images) that do not correspond to the advertised property or are unrelated to the advertised transaction (for example, images or videos related to the advertiser’s professional activity or a property other than the one listed). In resale listings, photographs must reflect the actual condition of the property. If infographics, renovation simulations, or any image generated or edited using AI or other manipulation tools are used, it must be indicated that the content is altered or simulated. These images must always be accompanied by photographs showing the current, actual condition of the property.

Do not publish multimedia content, whether your own or generated by third parties through the corresponding viewer service, that contains inappropriate, defamatory, or illegal content, materials, or information; that violates any third-party rights (including, in particular, image rights, data protection, or intellectual or industrial property rights); that contains the advertiser’s contact information, watermarks, logos, or text; or that is irrelevant or unrelated to the advertised property. Images containing personally identifiable information, such as vehicle license plates or photographs of people, may not be published either. If detected, we may remove them or, if appropriate, edit them by blurring (“blur”).

Do not include in the description of the advertisement information that is irrelevant or unrelated to the published property (for example, advertising content of the advertiser, of their professional activity, their own website or of other properties different from the one advertised).

Do not use capital letters in the ad description, beyond proper spelling.

Do not publish more than one advertisement for the same property simultaneously, nor repeatedly add and remove listings for the same property.

In case of publishing properties for holiday rentals or tourist use you must have all the necessary licenses and administrative authorizations for the legal operation of the business and include, where required, your registration number in the corresponding public registry.

Do not publish inaccurate prices (such as stating that the price includes a garage and adding the additional price of the garage in the property description).

Specify the energy class, accompanied by an image of the “energy certificate” that proves that the property has the certificate.

Anti-fraud measures or measures contrary to these General Terms and Conditions

In order to provide truthful information to our Users, we may penalize advertisers who violate the above-mentioned publication rules, including, for example, illegally gaining positioning for their ads in the Web listings or artificially triggering alerts to Users.

We will have the right, but not the obligation, to investigate all incidents of fraud reported by Users and, in such case, the advertiser must cooperate to carry out said investigation.

By using the publishing service, you acknowledge and accept that we will not be liable for any direct or indirect losses or damages related to the fraudulent use of the Services and, in particular, to the application of anti-fraud mechanisms and measures, including, without limitation:

  • the loss of income or profits;
  • the loss of business;
  • the loss of profits or contracts; and
  • data loss.

Intellectual and Industrial Property

By agreeing to these General Terms and Conditions, you acknowledge and accept that all rights to the materials and elements appearing on the Website (including, but not limited to, drawings, texts, graphics, maps, photographs, images, audio, video, distinctive signs, logos, trademarks, trade names, domains, software, etc.) belong to us, or where applicable, to third parties who have consented to the transfer of these rights to us, and therefore we have all the necessary rights and licenses for their use.

Specifically, it is not permitted to resell, deep-link, use, copy, monitor (e.g., spider, scrape), display, download, store, or reproduce the content, information, software, products, or services available on our website for any commercial or competitive activity without our prior written authorization.

The materials and information you publish on our Website when using the Services must respect any image rights, data protection rights, and intellectual and industrial property rights that may exist. Therefore, you acknowledge and agree to assume sole responsibility for any liability or damages that may arise in connection with this content.

By sharing or publishing information, non-personal data, photographs, or any other material with us (including internal Web messaging), you grant us a worldwide license for the maximum protection period allowed by law, with the possibility of sublicensing that information to affiliated companies and third parties.

In particular, you authorize:

  • Add our watermarks to prevent these photos from being published by unauthorized third parties.
  • We use information about properties advertised on our website to perform property valuations and appraisals, price reports, statistical reports, historical references, and other real estate market analyses. This information may be used even after the respective listings have been removed from the website.
  • To the distribution, reproduction, transformation and public communication of that material.
  • Similarly, if you are a photographer and use and/or access our website to upload photos, videos, and floor plans of properties that are the result of your work or service, by disseminating or publishing information, non-personal data, photographs, or any other material through this platform, you grant us a worldwide license for the maximum protection period permitted by law, with the possibility of sublicensing that information to affiliated companies and third parties. In this regard, you acknowledge that we have the right to disseminate all or part of the content of the listings for advertising campaigns, website promotion, blogs, etc.

Our responsibility

Our responsibility is that established legally by Law 34/2002, of July 11, on Information Society Services and Electronic Commerce and by Regulation (EU) 2022/2065, of the European Parliament and of the Council, of October 19, 2022 (Digital Services Regulation), which indicate that, in general, we cannot be responsible for the information published at the request of Users.

Although we make every effort to ensure that the published content is correct, we are under no obligation to exercise prior control over the truthfulness, accuracy, legality, relevance, or suitability of the materials published on the Website, as this information is stored at the request of Users.

However, should we detect or suspect any illegal activity or activity contrary to these General Terms and Conditions or the Specific Terms and Conditions, we will act with due diligence to remove the affected information or prevent access to it in accordance with applicable law.

We will not assume any responsibility for damages or losses that may arise from the relationship between Users as a result of their contacts or negotiations.

Access to and use of the Web requires a device or computer equipment and an Internet connection, so you accept that the associated costs will be your responsibility.

We are not responsible for the existence of any charge, encumbrance, right, dispute, mortgage, incident, lien or census that may affect the properties advertised on our Website, and you agree to hold us harmless from any liability or damage in this regard.

We are not responsible for the accuracy, integrity, truthfulness, legality or suitability of the information, materials and/or content available on third-party websites that you may access through links available on our Website.

Payment methods on the Web

As a property owner, you can contract some of our services, such as subscription service for extending the duration of your publications.

For the payments we use an e-commerce payment gateway provided by authorized banks. All data provided to us for this purpose is properly encrypted to ensure maximum security and confidentiality, and is stored on a secure server certified according to the Secure Socket Layer (SSL) protocol.
11. Contracting with third parties through the Web

You acknowledge and agree that any contractual or non-contractual relationship you enter into with any advertiser, User, Registered User, or third party through our Website will be solely and exclusively between you. We will not be a party to, nor assume any responsibility for, any damages or losses that may arise from that relationship.

Therefore, we recommend that you exercise caution when contacting or contracting with any advertiser, User, Registered User, or third party through our Website. If you have any doubts or suspect that any illegal activity, fraud, or conduct contrary to these General Terms and Conditions is taking place, we advise you not to make any payment or enter into any contract and to contact us. As soon as you detect it, we’ll do our best to help you resolve it.

Protection of personal data

By accessing the Website and/or using the Services, we may process your personal data. You can obtain detailed information about how and for what purpose we will process your data by consulting our Privacy Policy.

Applicable law and jurisdiction

These General Terms and Conditions are governed by the laws of Spain. Any clause of these General Terms and Conditions that is or becomes illegal, invalid, or unenforceable will be severed and replaced by a clause that most closely resembles it, without affecting the User or giving rise to any compensation. In this case, the remaining provisions or sections will not be affected.

Any conflict that may arise in relation to the interpretation and/or application of these General Conditions, will be submitted to and resolved by the Courts and Tribunals of the city of Madrid or by those that correspond according to the User’s domicile.

In order to comply with the procedural requirement established in Article 5 of Organic Law 1/2025, of January 2, on measures regarding the efficiency of the Public Justice Service, where applicable, the appropriate means of dispute resolution will be direct negotiation between the parties.
